MEDIDAS DE SEGURANÇA: EFICÁCIA E RESSOCIALIZAÇÃO DIANTE DAS CONDIÇÕES PRECÁRIAS DOS CENTROS PSIQUIÁTRICOS JUDICIÁRIOS

Resumo

As medidas de segurança são tipos de sanção penal baseadas não na ideia de punição, vez que o agente não tem autodeterminação, mas atua num viés preventivo, de proteção à sociedade da periculosidade que o sujeito ainda pode apresentar. Os centros psiquiátricos judiciários são os estabelecimentos onde esses “pacientes” (como lá são chamados) ficarão internados e receberão tratamento por força de sentença absolutória imprópria ou de decisão superveniente (transferências). A eficácia desse tratamento, bem como a reinserção desses indivíduos na sociedade é matéria de Direito Penal que deveria ser objeto de estudos e pesquisa mais aprofundados.

Measures of reform and prevention are kinds of penal sanction based not on the idea of punishment, since the agent does not have autodetermination, but on a preventive bias, of protection of the society from the dangerousness that this person still can present. The judicial psychiatric centers are the institutes where the “patients” (as they're called there) will be admitted and will receive treatment by the force of an improper acquittal sentence or a supervening decision (by transferences). The efficiency of this treatment, as well as the reintegration of these people into society is a matter of Criminal Law which should be the object of deeper studies and researches.
